When you need a sworn statement of fact to support an application or claim.
When a bespoke document is needed instead: For a statutory declaration (non-court use) — use that document instead.

Drafting notes
- First-hand facts
- Depose to facts within your own knowledge; for anything on belief, state the source — a defective affidavit can be struck out.
- Number paragraphs
- Use numbered paragraphs and attach and mark exhibits where referred to.
- Competence
- State your capacity and that you are competent to swear the affidavit.
- Jurat
- Complete the jurat — sworn/affirmed before a Commissioner for Oaths, with place and date.
Execution requirements
- The deponent swears the affidavit before a Commissioner for Oaths, who completes the jurat (Oaths Act; Commissioners for Oaths (Advocates) Act).
- Attach and mark any exhibits referred to.
- File and serve the affidavit with the application it supports.
