Drafting notes
- Report the death
- Report the death and full estate particulars to the Administrator General.
- Relatives’ consent
- Attach the consents of other beneficiaries — the office often asks for them before issuing.
- Small estates
- If it is a small estate, note the exemption and apply directly to the court instead.
- Identification
- Enclose the applicant’s identification and the death certificate to avoid delay.
Execution requirements
- Submit the request to the Administrator General’s office with the death certificate and estate particulars.
- The certificate of no objection is required before a grant to anyone other than an executor, widow/widower or their attorney (Administrator General’s Act s.5).
- On receiving the certificate, attach it to the petition for letters of administration.
