Drafting notes
- Be complete
- List every asset and liability with values; an inaccurate inventory is a ground for revocation of the grant.
- Timing
- Exhibit the inventory within six months of the grant and the account within one year; ask the court to extend if needed.
- Supporting documents
- Keep receipts, valuations and bank statements supporting the account, ready for the court.
- Distributions
- Record distributions to each beneficiary and obtain their acknowledgements.
Execution requirements
- The administrator verifies the inventory and account before a Commissioner for Oaths and files them in the court that made the grant.
- Exhibit the inventory within six months and the account within one year of the grant (Succession Act s.273); the court may extend.
- Failure to inventory or account is a ground for revocation of the grant.
- Retain the supporting valuations, receipts and beneficiary acknowledgements.
