Drafting notes
- Cause of action
- Plead a complete cause of action and every material fact — omitting an element risks the suit being struck out.
- Right court
- Choose the court by pecuniary and territorial jurisdiction, and plead jurisdiction expressly.
- Relief & interest
- Claim the principal relief, damages, interest, costs and a general prayer.
- Time
- Confirm the claim is within the limitation period before filing.
Execution requirements
- The plaint is verified and filed with the prescribed court fees.
- Serve summons and the plaint on the defendant per Order 5 of the Civil Procedure Rules.
- The exact filing fee depends on the claim value — confirm at the registry.
