SPOUSAL CONSENT TO A TRANSACTION IN FAMILY LAND
(Under section 40 of the Land Act, Cap. 236, and the Land Regulations — Form 37)
1. The consenting spouse & land
1.1 I, [SPOUSE FULL NAME], (NIN [NIN]) of [ADDRESS], am the spouse of [PROPRIETOR NAME], the registered proprietor of land comprised in [DESCRIPTION — tenure, block, plot, location] (“the Land”), which is family land.
2. The transaction
2.1 The proprietor proposes to [sell / mortgage / lease / transfer / exchange] the Land to [COUNTERPARTY] on the terms of the [agreement / instrument] dated [DATE].
3. Consent
3.1 I CONSENT to the said transaction in the Land.
4. Acknowledgement of understanding
4.1 I confirm that: (a) the nature and effect of the transaction have been explained to me; (b) I understand that it affects family land in which I have an interest; and (c) I give this consent freely and without coercion.

Drafting notes
- Identify the spouse
- Confirm the marriage and that the person consenting is in fact the proprietor’s spouse; attach proof of marriage where available.
- Free and informed
- The consent must be free and informed — record that the transaction and its effect were explained to the spouse.
- Form 37
- Where the registry requires it, give the consent on the prescribed Form 37 so the registrar will register the transaction.
- Illiterate consenting party
- If the spouse cannot read, have the consent read and explained, and record a certificate of translation/explanation.
- Effect of absence
- A dealing in family land without this consent is void — even against a good-faith purchaser.
Execution requirements
- The spouse signs, ideally before a Commissioner for Oaths.
- Lodge the consent (Form 37) with the transaction for registration — the registrar will not register a family-land transaction lacking it.
- Keep the consent on the transaction file; a non-consented dealing is void even for a good-faith purchaser.
- Where the spouse is illiterate, add a certificate that the consent was read over and explained.
