1. Decision
1.1 Following [the disciplinary process concluded on [DATE] / our discussions], the Employer has decided to terminate your employment with effect from [DATE].
2. Reason
2.1 The reason for termination is [state the valid reason — e.g. proven misconduct / poor performance after warnings / incapacity].
3. Notice
3.1 You will [serve [NOTICE] notice working to [DATE] / be paid [NOTICE] in lieu of notice]. Termination without the required notice would be unlawful, which is why notice/pay in lieu is given.
4. Final entitlements
4.1 Your final pay will include: salary to the termination date; payment for accrued but untaken leave; pay in lieu of notice (if applicable); and severance allowance (if the qualifying conditions are met).
5. Return of property & certificate
5.1 Please return all Employer property by [DATE]. A certificate of service is enclosed / will follow.

Drafting notes
- State the reason
- Record the valid reason — the Employer must be able to prove it if challenged.
- Notice
- Give the required notice or pay in lieu; without notice the dismissal is unlawful.
- Final pay
- Settle salary, accrued leave, pay in lieu and any severance allowance, and itemise them.
- Certificate of service
- Issue a certificate of service and arrange the return of property.
Execution requirements
- The Employer signs and serves the letter.
- A dismissal needs a valid reason and a fair procedure (s.67); termination without notice is unlawful (s.58).
- Pay severance allowance where the qualifying conditions are met (s.87).
- Issue a certificate of service.
