Facts
In February 2017 the Defendant obtained a credit facility of UGX 240,000,000 from the Plaintiff bank, secured by a mortgage over land comprised in Block 858 Plots 8 and 9 at Misozi. The Defendant defaulted on repayment and introduced a potential buyer, Atumanya Anxious, who agreed to purchase the security for UGX 280,000,000. The Plaintiff executed a sale agreement and issued an undertaking to refund the purchase price if transfer could not be effected.
