Holding
The Uganda Human Rights Commission Tribunal dismissed a complaint alleging violation of the right to life where the complainant failed to prove on a balance of probabilities that the deceased's death from respiratory failure was caused by alleged torture by police officers. The tribunal held that although the deceased was arrested and detained, the medical evidence showed death resulted from respiratory failure due to infection with no established nexus to the alleged torture. The tribunal further held that a claim for violation of the right to personal liberty cannot be pursued where the victim died before the complaint was lodged.
Outcome
Complaint dismissed with no compensation awarded
Facts

On 4 August 2009, he reported to Hannah Medical Services with chest pain, fever, cough and night sweats. On 17 August 2009, he was admitted to Wakiso District Council Entebbe Hospital with respiratory distress, persistent cough unresponsive to antibiotics, weight loss and fever, and died the same day.
