Kayla Joy Babirye Nyangoma was born in March 1990 to Komungalu Aida and Sedulaka Kafulamu of Maddu, Gomba. Her mother died during childbirth. The infant and her twin sister were placed in Sanyu Babies Home orphanage with consent of a Juvenile Court. The twin sister passed away in September 1990. In January 1991 the infant was returned to her father but her condition deteriorated. The Probation and Welfare Office retook possession and returned the infant to the orphanage due to the father's and his wives' inability to care for her. Nina Rochon, a 25-year-old Canadian nurse volunteering in Uganda, expressed interest in caring for the infant. The Probation and Welfare Office found her fit and proper. On 27 February 1992 the Magistrates Court at Mengo committed the infant to Rochon's care until 27 May 1992 under the Approved Schools Act. On 1 June 1992 a further order committed the infant to Rochon until age 16. Rochon sought formal guardianship as she intended to return to Canada and take the infant with her.
