Holding
The court dismissed the plaintiff's claim for cancellation of title and compensation on grounds of fraud. The sale agreement showed that only Plot 333 was sold, not Plots 332 and 334. The plaintiff failed to prove fraud on the balance of probabilities where the vendor's signature on the transfer forms was not disputed, and the plaintiff delayed 30 years before bringing the action. The court noted that the land had changed hands to parties not joined to the suit.
Outcome
Suit dismissed — plaintiff advised to bring all interested parties if pursuing remedies subject to limitation period
Facts
On 23 May 1978, the plaintiff's father Ssali Lwanga sold land comprised in Kyadondo Block 34 Plot 333 to the first and second defendants. Ssali handed the mother title to the defendants through their advocate for sub-division and issuance of duplicate certificates. The subdivision took long; the proprietor fell ill and died. The plaintiff contended that the defendants fraudulently transferred not only Plot 333 but also Plots 332 and 334 into their names using the transfer form meant for Plot 333 only. The plaintiff discovered this in 2008 when he applied for a search, some 30 years after the transaction. Defendants could not be served and the matter proceeded exparte. The land registry indicated that the land had changed hands to different parties and a school was sitting on part of it.
