Holding
Held that the defendant bank had taken out a group insurance policy as contracted. The plaintiff was compensated for unlawful termination of employment by Uganda Revenue Authority and received UGX 37,000,000 in damages, which represented compensation for salary loss. Having been compensated for loss of employment, the plaintiff could not claim financial disability relative to his employment. The sale of the plaintiff's truck arose from execution of a warrant of arrest and was a matter for determination in execution proceedings under s.34 of the Civil Procedure Act, not in a separate suit for breach of contract. Suit dismissed with costs.
Outcome
Suit dismissed with costs to the defendant
Facts
On 27 June 2005 the plaintiff applied for a salary loan of UGX 42,000,000 from the defendant bank, which was approved on 30 June 2005. UGX 1,685,000 was deducted for group insurance premium to cover the loan against death and disability. On 20 July 2005 the plaintiff's employment with Uganda Revenue Authority was terminated. The defendant demanded outstanding loan payments from the plaintiff personally. The plaintiff made some repayments but could not service the loan. The defendant filed HCCS No. 473 of 2006 and obtained judgment. A consent decree was entered for monthly instalments. The defendant obtained a warrant of arrest against the plaintiff, who was committed to prison from 9 April 2008 to 28 June 2008. The plaintiff's truck was sold for UGX 19,000,000 following a sale agreement made under threat of arrest. The plaintiff later successfully sued Uganda Revenue Authority for unlawful termination and was awarded UGX 37,000,000 as damages for loss of employment, but did not apply this sum to settle the bank loan.
Issues
- Whether the defendant breached the loan agreement by failing to take out an insurance policy to insure the loan?
- Whether the risks sought to be insured against occurred?
- Whether the defendant's bailiffs attached and sold the plaintiff's truck registration number UAG 240 P and if so whether the defendant is liable?
- What remedies are available to the parties?
Orders
- Plaintiff's plaint dismissed.
- Costs awarded to the defendant.
