Holding
The Tribunal held that the first disconnection for suspected meter tampering was unlawful where the meter was tested and found without fault after an unreasonable delay of nearly five months. The fraud charge of UGX 981,289.70 was unlawfully imposed as the Respondent provided no basis or evidence for the estimate. The second disconnection for nonpayment of bills was lawful. The Complainant was awarded general damages of UGX 4,500,000 and aggravated damages of UGX 1,000,000 with interest at 24% per annum, plus costs.
Outcome
Complaint partly allowed with damages and costs awarded to the Complainant
Facts
The Complainant operated ten rentals supplied with electricity through one meter by the Respondent. On 18 October 2013, the Respondent disconnected the supply alleging meter seal tampering and imposed a fraud charge of UGX 1,150,521. The Complainant disputed the allegation and lodged a complaint with the Electricity Regulatory Authority (ERA) on 26 November 2013. ERA recommended meter testing, which was conducted on 11 February 2014 and found no tampering or malfunction. The meter was reinstalled on 13 February 2014, ending a disconnection of nearly five months. On 4 April 2014, the Respondent disconnected supply again for an outstanding bill of UGX 1,322,983, which included the fraud charge. After the fraud charge was reversed, the Complainant paid UGX 322,693.73 and supply was restored on 11 April 2014. The Complainant claimed loss of rental income as tenants left during the disconnections.
