Holding
The High Court revoked four Letters of Administration fraudulently obtained by the defendant in respect of multiple estates. The defendant obtained grants by fraud, misrepresentation, and from courts lacking pecuniary jurisdiction; failed to file inventories or accounts; dealt with estate property without authority; and wrongfully registered estate land in his name as administrator. The court ordered cancellation of the defendant's registration on the land titles and a permanent injunction restraining further dealings with the estates.
Outcome
Letters of Administration revoked; defendant's registration on land titles cancelled; lands reinstated in names of original owners; permanent injunction issued; damages and costs awarded to plaintiffs
Facts
The deceased Yosiya Semugoma Bwete died in 1930 leaving an estate of four square miles (approximately 1,036 hectares) of land at Balita, Nakaseke District. The defendant, a relative, fraudulently obtained Letters of Administration for the estate of Yosiya Semugoma Bwete and the estates of three of his children (Zakaliya Kanyike Mubanda, Rev. Samson Bwete Kyobe, and Damba Kiviiri Blasio) from courts lacking pecuniary jurisdiction. The defendant obtained grants without family authorization, failed to notify the Administrator General, never filed inventories or accounts, and registered himself as proprietor on land titles comprising Bulemezi Block 798 plots 30, 31, 32, and 35 in 2016. The plaintiffs, who are descendants and beneficiaries of the estates, discovered the fraud and sued for revocation. The defendant was served but did not file a defence or participate in proceedings, and the suit proceeded ex parte.
