Holding
The Tribunal held that police officers shot and accidentally killed Musinguzi Patrick while acting in self-defense against an advancing crowd of over 200 demonstrators armed with sticks and stones. The killing did not constitute a violation of the right to life under Article 22(1) of the Constitution, as the officers faced imminent threat of death and acted proportionately after warning shots failed. The state was held vicariously liable for the accidental killing. Compensation of UGX 12,000,000 was awarded, reduced to reflect the deceased's contributory conduct.
Outcome
Complainant awarded UGX 12,000,000 as general damages for accidental killing; state held vicariously liable but no violation of right to life found
Facts
On 22 February 2009, Nsiima Herbert, his brother Musinguzi Patrick, and over 200 people went to protest threatened eviction from land in Ruhangira village, Kyenjojo. About 10 policemen were guarding the disputed land. The crowd, armed with sticks and stones, advanced toward the officers. Police fired six warning shots in the air, but the crowd continued advancing to within three metres of the officers. Police then fired directly at the crowd. Musinguzi Patrick was shot in the iliac region; the bullet penetrated through to the other side, causing his intestines to protrude. He died from severe hemorrhage. A postmortem examination confirmed death by gunshot wound. The Regional Police Commander and Resident District Commissioner attended the funeral, with the RDC publicly stating he would engage the District Police Commander for amicable settlement.
