Holding
The Uganda Human Rights Commission held that police at Nebbi Central Police Station violated Oyera Komakech Innocent's constitutional right to life under Article 22(1) when he died in their custody without satisfactory explanation. The state failed to discharge its burden to explain the death of a detainee who entered custody alive. The Attorney General was held vicariously liable for the acts of police officers. The complainant was awarded UGX 15,000,000 in compensation for the violation of her grandson's right to life.
Outcome
Complaint allowed; compensation awarded to complainant for violation of grandson's right to life while in police custody
Facts
On 17 June 2008, Oyera Komakech Innocent was taken to Nebbi Police Station by his father and detained. The complainant, his grandmother, visited him at the station and found him alive and well. On 20 June 2008, she was informed that he had died and his body had been taken to the mortuary. Upon viewing the body, she observed a wound on his neck and alleged his private parts had been cut off. The post-mortem report revealed three wounds on the head, multiple bruises on the back, legs and hands, and a depressed skull fracture. The cause of death was determined to be a depressed fracture on the head and other wounds causing bleeding in the kidney, caused by a blunt object.
