Holding
The accused was convicted of murder based on circumstantial evidence. The court held that where the accused was last seen following the deceased into the night with a sharp knife after a domestic quarrel, and the deceased was found stabbed and mutilated the next morning, and the accused showed lack of concern about her disappearance, the circumstantial evidence was overwhelming and inconsistent with innocence. The court rejected a manslaughter submission where no defence of provocation, intoxication, or accident was raised.
Outcome
Accused convicted of murder
Facts
On 23 February 2013, the deceased Amayo died from stab wounds to the neck and abdomen and strangulation. Her genitalia had been removed and both knees were dislocated. On the night before her death, the accused and deceased quarreled and fought at their home around 8:00pm. The deceased left to report death threats to the LC1 Chairperson. The accused's stepdaughter (PW1) testified that around 10:00pm the accused followed the deceased, carrying a knife used for slashing sweet potatoes, saying he was following the mother but was unsure if he would return. The next morning the deceased was missing. Her body was found in nearby gardens at the boundary of the LC1 Chairperson's land. There was a history of domestic violence and disputes over the custody of stepchildren between the accused and deceased. Both were HIV-positive and on treatment. The accused claimed he came home tired from grazing cattle, found his wife absent, assumed she was drinking with friends, and went to sleep. He said he looked for her the next morning without success before taking his cattle to graze.
