Holding
The court held that the prosecution had disclosed sufficient evidence to establish substantial grounds to believe all three accused committed the offences charged. The court confirmed charges of aggravated trafficking in children against A1 and A3, aggravated defilement against A1, and promoting trafficking against A2, applying the Rome Statute standard requiring substantial grounds to believe rather than proof beyond reasonable doubt at the pre-trial stage.
Outcome
All charges confirmed and referred for trial
Facts
A1, the LCV Chairman of Bukwo District, sought to lure a 16-year-old primary school student into a relationship. On 21 October 2022, he sent A3, the victim's uncle, to entice and transport the victim to the home of A2. A3 brought the victim to A2's home where A1 was waiting in a visitor's bedroom. A1 gave money to A3 for his role. That night, A1 had sexual intercourse with the victim, promising marriage and to take her to Kampala. The next day, A1 left the victim at A2's home where A2's wife provided food. A3 later informed the victim that A1 could not return as he was at police for investigation of a similar offence. The victim wandered among friends' homes until 27 October when her sister found her and she disclosed the events, leading to a police report.
