Holding
Court accepted plea bargain agreement and sentenced accused to seven years' imprisonment for aggravated defilement of a 10-year-old child. The sentence was imposed following a guilty plea in a plea bargaining session. Court reviewed the Sentencing Guidelines and comparable sentencing practice, considered aggravating factors including the victim's age and prevalence of the offence, and mitigating factors including the accused's guilty plea, remorse, young age, and time spent on remand.
Outcome
Accused convicted and sentenced to seven years' imprisonment
Facts
On 23rd May 2016 at Busia village, Koboko District, the accused asked the 10-year-old victim to help him search for a lost sewing needle. They then went to a nearby bush purportedly to search for a herb for skin disease. In the bush, the accused undressed the victim, placed her on the ground, and had sexual intercourse with her while clasping her mouth. The victim disclosed to her father Moses that this was the fourth time the accused had taken her to the bush and had intercourse with her. The accused was arrested and taken to Busia Police Post. Medical examination at Koboko Hospital on 24th May 2016 confirmed the victim was 10 years old based on dental development, of normal mental status, with a ruptured hymen, probable cause being penile penetration. The accused was 21 years old at the time.
