Holding
The court convicted the first accused, Kabayo Yohana, of murder after finding that the single identifying witness (PW2) gave credible identification evidence placing him at the scene administering a fatal blow to the deceased with a blood-stained spear. The court inferred common intention to kill from the sequence of events. The third accused, Musinguzi Nicholas, was acquitted as no evidence linked him to the murder beyond assault on another victim. The second accused, Kato Joshua, had earlier pleaded guilty and been sentenced to 16 years imprisonment after plea bargaining.
Outcome
First accused convicted of murder; third accused acquitted and discharged; second accused had already been convicted on guilty plea and sentenced to 16 years imprisonment
Facts
On 13 May 2012 at Kibale village, Rukungiri District, cows belonging to Mr Katsigazi strayed onto A3's garden. A3 assaulted the herdsman (PW1) and ordered him to call Mayumba. PW1 called for help. Mayumba (PW3), Ham Aijyuka (PW2), and the deceased Peter Godwill responded. They went to see the destroyed crops and found the three accused armed with spears, pangas and walking sticks. A3 cut Mayumba on the head with a panga. A2 speared PW2 on the back causing him to fall, then speared the deceased in the stomach. When the deceased attempted to stand, A1 stabbed him in the ribs with a blood-stained spear. The deceased died from the stab wounds. PW2 lost consciousness and regained it seven days later in hospital. A2 pleaded guilty after plea bargaining with the prosecution and the deceased's father. A1 and A3 denied the offence and claimed self-defence, alleging they were attacked by an armed group from Katsigazi's home.
