Holding
Held that the accused unlawfully caused the death of his five-year-old son through physical abuse but the state failed to prove malice aforethought. The deep scars and intermittent wounds disclosed an intention to inflict pain rather than cause death. The accused was convicted of manslaughter under s.187 of the Penal Code Act and sentenced to nine years eight months imprisonment after deducting time on remand.
Outcome
Accused convicted of manslaughter and sentenced to nine years eight months imprisonment
Facts
On 14 May 2022, the accused Nsubuga Godfrey alias Malobba caused the death of his five-year-old son Mubiru Tendo. The child had been living with a neighbor, Namasaka, because the accused had neglected him. The accused collected the child to celebrate Eid. On the day of death, witnesses saw and heard the accused assault the child severely. The child disclosed to a 14-year-old witness, Lukyamuzi, that his father had beaten and burnt him with a flat iron. Lukyamuzi observed injuries on the child's head, chest, hips and legs and witnessed the assault continuing until the child collapsed. The child was taken to Nakaseke Hospital where he was pronounced dead at approximately 7 p.m. Medical examination revealed bruises on the scalp and abdomen, previous burns and scars on upper limbs and scalp, and determined the cause of death as internal hemorrhage due to recent assault. Evidence showed the accused had subjected the child to physical abuse over a period of time prior to the fatal assault.
