Holding
The High Court found no prima facie case established against three accused persons charged with aggravated robbery. The prosecution called only one witness who did not place the accused at the scene of the crime. The victim named in the indictment did not testify, no community members who arrested the first accused testified, and no stolen properties were exhibited. The court held that without evidence proving the essential ingredient that the accused participated in the attack and robbery, no reasonable tribunal could convict. All three accused were acquitted and discharged.
Outcome
All three accused acquitted and discharged
Facts

The attackers stole ten plastic chairs, three spades, one umbrella stand, two fire extinguishers, one baton, one rechargeable torch and an occurrence book, valued at UGX 700,000. On 5 March 2016, community members alerted security and police that the first accused, a former Saracen (U) Ltd employee, possessed stolen items he had buried. Police arrived to find the community had arrested the first accused with two fire extinguishers, two chairs, a baton and a torch. He was handed to Ngara Police.
