IN EXERCISE of the powers conferred upon the Minister responsible for sports by section 79 of the National Sports Act, and in consultation with the Board of Council, these Regulations are made this 11th day of March, 2025.

Part I

1. Citation

These Regulations may be cited as the National Sports Regulations, 2025. 2. Interpretation In these Regulations, unless the context otherwise requires-

"Act" means the National Sports Act;

"Council" means the National Council of Sports established by section 27 of the Act;

"currency point" means has the value assigned to it in Schedule 1 to these Regulations;

"Minister" means the Minister responsible for sports;

"sports dispute" means a disagreement relating to the interpretation or application of-

(a)

the Act; (b) these Regulations; or (c) the statutes of national sports organisations.

Part II

3. Application for declaration of national sport
(1)

A person who intends to have a sports discipline declared a national sport shall-

(a)

apply to the Council in Form 1 prescribed in Schedule 2 to these Regulations; and

(b)

pay the application fees prescribed in Schedule 3 to these Regulations.

(2)

The Council shall, in determining whether a sports discipline is eligible for declaration as a national sport, consider the requirements under section 6 of the Act.

(3)

The Council shall, within thirty days from the date of receipt of the application, and upon being satisfied that the applicant meets the requirements referred to in subregulation (2), issue a certificate of recognition in Form 2 prescribed in Schedule 2 to these Regulations.

(4)

A certificate of recognition of a sports discipline shall be valid until revoked by the Council.

(5)

The promoter of the sports discipline recognised under subregulation (3) shall promote the sports discipline and register a national sports association in respect of the sports discipline, within five years from the date of recognition.

(6)

The Council may withdraw the recognition of a sports discipline for noncompliance with subregulation (5).

(7)

A sports association referred to in subregulation (5) shall affiliate with an international body managing the sports discipline except where there is no international body managing the sports discipline.

(8)

A person dissatisfied with the decision of the Council may in writing within fourteen days from the date of receipt of the decision, appeal to the Minister.

Part III

4. Application for registration of national sports association
(1)

A person who intends to register a national sports association shall-

(a)

apply to the Council in Form 3 prescribed in Schedule 2 to these Regulations; and

(b)

pay the application fees prescribed in Schedule 3 to these Regulations.

(2)

The Council shall, in determining an application for registration of a national sports association, consider the requirements under sections 9 and 11 of the Act.

5. Application for registration of national sports federation
(1)

A person who intends to register a national sports federation shall-

(a)

apply to the Council in Form 3 prescribed in Schedule 2 to these Regulations; and

(b)

pay the application fees prescribed in Schedule 3 to these Regulations.

(2)

The Council shall, in determining an application for registration of a national sports federation, consider the requirements under sections 10 and 11 of the Act.

6. Constitution of national sports association and national

sports federation The Constitution of a national sports association and national sports federation shall include- (a) the composition of the general assembly, consisting of members duly registered by the national sports association or national sports federation;

(b)

the procedure for admission, suspension and dismissal of members;

(c)

the mandatory annual general meeting or assembly;

(d)

the powers of the general assembly including-

(i)

amendment of the Constitution and any other statutes of the national sports association or national sports federation;

(ii)

considering and passing the financial statements of the previous financial year of the national sports association or national sports federation;

(iii)

considering and passing the financial projections or budgets of the next financial year of the national sports association or national sports federation;

(iv)

appointing external auditors for a stated period;

(v)

electing the executive committee of the national sports association or national sports federation; and

(vi)

determining and passing of the annual membership fees and the benefits of fully paid-up members;

(e)

the composition of the executive committee;

(f)

mandatory quarterly executive committee meetings;

(g)

the powers and obligations of the executive committee including-

(i)

organising the general assembly;

(ii)

presenting matters and drawing proposals for consideration of the general assembly;

(iii)

appointing and supervising a secretariat for the national sports association or national sports federation;

(iv)

making regulations of the national sports association or national sports federation as provided for in the statutes and their constitutions;

(v)

implementing the decisions of the general assembly through the secretariat of the national sports association or national sports federation;

(vi)

taking decisions not reserved for any other body of the national sports association or national sports federation; and

(vii)

maintaining and updating the list of members;

(h)

publication of the annual audited books of accounts in media of wide circulation;

(i)

the recognition of the jurisdiction of arbitrators appointed under the Act and obligating the settlement of sports disputes between the national sports association or national sports federation and its members or the Council;

(j)

the recognition of the decision of arbitrators as final;

(k)

the obligation of national sports association or the national sports federation and its members to respect and comply with the decisions of arbitrators;

(l)

the prohibition of settlement of sports disputes between a national sports association or a national sports federation and its members by the courts of judicature, including the interpretation and application of the constitution and regulations of the national sports association or the national sports federation; and

(m)

the rights and obligations of member including-

(i)

payment of annual membership fees; and

(ii)

electing the leadership of the national sports association or national sports federation.

7. Consideration of application for registration of national

sports association and national sports federation (1) The Council shall-

(a)

publish an application received under regulation 5 and 6 in the Gazette and in media of wide circulation in Uganda; and

(b)

invite objections to the application from the public.

(2)

An objection made under this regulation shall be submitted to the Council in writing within thirty days from the date of publication of the application in the Gazette.

(3)

Upon receipt of an objection, the Council shall notify the applicant of the objection and instruct the applicant to provide a written response within fourteen days from the date of notification.

(4)

The Council may, upon written request by the applicant, extend the time within which the applicant is required to respond to the objection.

(5)

The Council shall consider the objection and communicate its decision to the parties within seven days from the date of receipt of the written response of the applicant.

(6)

The Council may, on its own motion, reject an application for registration of a national sports association or national sports federation in accordance with section 12 (3) of the Act.

(7)

Where the Council rejects an application for registration of a national sports association or national sports federation, the Council shall, within seven days, notify the applicant, in writing, stating the reasons for the rejection.

(8)

A person dissatisfied with the decision of the Council may appeal to the Minister, in writing, within fourteen days from the date of receipt of the decision.

8. Certificate of registration
(1)

Subject to section 12 of the Act, the Council shall, within sixty days from the date of receipt of an application, and upon being satisfied that the applicant meets the requirements referred to under regulations 5, 6 and 7, register the national sports association or national sports federation and issue a certificate of registration in Form 4 prescribed in Schedule 2 to these Regulations.

(2)

Notwithstanding subregulation (1), the certificate of registration of a national sports association or national sports federation shall be issued upon payment of the fees prescribed in Schedule 3 to these Regulations.

(3)

A certificate of registration issued under these Regulations shall be conclusive evidence of authorisation to operate as a national sports association or a national sports federation within Uganda.

(4)

The certificate of registration issued under these Regulations shall be valid for a period of one year from the date of issuance.

9. Renewal of certificate of registration
(1)

A national sports association or national sports federation that intends to renew a certificate of registration shall-

(a)

apply to the Council for renewal in Form 3 prescribed in Schedule 2 to these Regulations; and

(b)

pay the application fees prescribed in Schedule 3 to these Regulations.

(2)

Regulations 7 and 8 shall apply in considering an application for renewal of a certificate of registration.

10. Revocation of certificate of registration
(1)

Subject to section 15 of the Act, the Council may revoke a certificate of registration issued under regulation 8.

(2)

The Council shall provide a national sports association or national sports federation whose certificate is to be revoked, an opportunity be heard.

(3)

Notwithstanding subregulation (2), the certificate of registration of a national sports association or national sports federation shall not be revoked unless-

(a)

a period of six months has been given to the national sports association or national sports federation to rectify the issues that led to the decision to revoke the certificate; and

(b)

the grace period has not been heeded to by the national sports association or national sports federation.

(4)

Where the Council revokes a certificate of registration, the Council shall, in writing, notify the national sports association or national sports federation whose certificate has been revoked.

(5)

A national sports association or national sports federation whose certificate has been revoked may, in writing, appeal to the Minister within fourteen days from the date of receipt of the decision.

(6)

The Council shall, within thirty days from the date of cancellation of a certificate of registration-

(a)

remove from the register of national sports associations or national sports federations, the national sports association or national sports federation whose certificate of registration has been cancelled;

(b)

give notice of the revocation of the certificate of registration in the Gazette and in media of wide circulation; and

(c)

request the international sports governing body to which the national sports association or national sports federation whose certificate has been revoked is affiliated, to appoint a normalisation committee to manage the affairs of the national sports association or national sports federation.

(7)

For the avoidance of doubt, the responsibility to appoint a normalization committee under subregulation (6)(c) shall vest in the respective international sports governing body.

(8)

The normalisation committee appointed under subregulation (6)(c) shall conclude its assignment within a period of six months from the date of the appointment.

(9)

Notwithstanding subregulation (8), the Minister may extend the period of six months upon the request by the international sports governing body but in any case not exceeding one year.

11. Transformation into national sports federation
(1)

A registered national sports association that meets the requirements of regulation 6 may-

(a)

apply to the Council for transformation into a national sports federation in Form 5 prescribed in Schedule 2 to these Regulations; and

(b)

pay the fees prescribed in Schedule 3 to these Regulations.

(2)

Where the Council is satisfied that the association in subregulation (1) meets the requirements of regulation 6, the Council shall within thirty days-

(a)

revoke the certificate of registration of the association;

(b)

remove the association from the register; and

(c)

issue a certificate of registration as a federation.

(3)

A national sports association that is dissatisfied with the decision of the Council may, in writing, within fourteen days, appeal to the minister.

12. Register of national sports associations and national sports

federations (1) The Council shall maintain a register of national sports associations and national sports federations registered under these Regulations in Form 6 prescribed in Schedule 2 to these Regulations.

(2)

A national sports association or a national sports federation shall, within twenty-one days, in writing, notify the Council of any changes in the information in the register.

(3)

A person who intends to inspect the Register shall-

(a)

apply to the Council, in writing, for inspection of the Register; and

(b)

pay the inspection fees prescribed in Schedule 3 to these Regulations.

13. Membership of national sports organisations
(1)

A national sports association or national sports federation shall define its membership in its constitution.

(2)

A national sports association or national sports federation shall, at the beginning of each calendar year, submit a copy of the register of its members to the Council.

(3)

The membership of a national sports association shall comprise of clubs registered by the association and the membership of a national sports federation shall comprise of clubs and associations registered by the federation.

Part IV

14. Participation in sports competitions outside Uganda
(1)

A national sports association or national sports federation which intends to participate in sports competitions outside Uganda shall in writing apply to the Council.

(2)

The application in subregulation (1) shall be accompanied with-

(a)

confirmation of participation from the international sports organisation of the applicant's discipline;

(b)

a resolution of the executive committee of the sports association or federation confirming participation in the competition;

(c)

a copy of the calendar of sports activities, work plan and budget for the financial year approved by the Council;

(d)

a copy of the list of participants and their travel documents, including national identity cards, and, where applicable, passports and visas; and

(e)

copies of consent letters of participants under the age of eighteen years from their parents or guardians.

(3)

The Council shall consider the application submitted in subregulation (1) within fourteen days from the date of receipt of the application.

(4)

Where the Council rejects an application under this regulation, the Council shall inform the applicant, of the rejection in writing stating the reasons for rejection.

(5)

An applicant who is dissatisfied with the decision of the Council under this regulation shall, within fourteen days after the decision, in writing appeal to the Minister.

15. Management of sports teams and athletes in international

sports competitions (1) Uganda national teams and athletes may participate in the qualifiers and final competitions of-

(a)

the Olympics;

(b)

the Commonwealth Games;

(c)

paralympics;

(d)

special Olympics;

(e)

deaflympics;

(f)

multisport competitions;

(g)

Islamic solidarity games;

16. Organising of national sports competitions
(1)

A person who intends to organise a sports competition in Uganda shall-

(a)

apply to Council for a certificate of competition compliance in Form 7 prescribed in Schedule 2 to these Regulations; and

(b)

attached a recommendation of the respective national sports association or national sports federation.

(2)

Where the national sports competition is organised by the national sports association or national sports federation managing that sport, the council may issue a certificate of competition compliance without the need for recommendation referred to in subregulation (1).

Part VI

18. Application for certification as agent, promoter or manager

of athletes (1) A person who intends to be an agent, promoter or manager of an athlete shall apply to the respective national sports association or national sports federation of the athlete for certification.

(2)

The national sports association or national sports federation shall, within fourteen days from the date of receipt of the application and upon being satisfied with the application in subregulation (1) issue a certificate to the applicant.

(3)

An athlete who intends to use the services of an agent, promoter or manager shall only use the services of an agent, promoter or manager certified under these Regulations.

(4)

A certificate issued under subregulation (3) shall indicate-

(a)

the name of the licensee;

(b)

the sports discipline;

(c)

the service under certification; and

(d)

the period of certification.

(5)

A national sports association or national sports federation shall submit to the Council, a list of certified agents, promoters and managers at the beginning of each financial year.

(6)

A certificate issued under this regulation shall be valid for a period of twelve months.

19. Management contracts for agents, promoters and managers

The management contract of an agent, promoter or managers of an athlete shall indicate-

(a)

the details of parties, including the guardian where the athlete is a minor;

(b)

that settlement of sports disputes shall be by arbitration;

(c)

the date of execution of the contract;

(d)

the duration of the contract which shall be for a period not exceeding two years from the date of execution;

(e)

that the contract may be renewed by the parties;

(f)

the consideration; and

(g)

any other information that the national sports association or national sports federation may deem necessary with the approval of the Council.

Part VII

20. Register of beneficial owners
(1)

Subject to section 24 of the Act, a national sports organisation shall record in its register of beneficial owners, the following additional particulars-

(a)

the email addresses and mobile telephone numbers of each beneficial owner;

(b)

the nature of the business activities which the beneficial owner is engaged in; and

(c)

the immigration status, passport and visa details and work permit status, where applicable, where the beneficial owner is a foreigner.

(2)

A national sports association, national sports federation and community sports club shall record the particulars of the beneficial owners in Form 9 prescribed in Schedule 2 to these Regulations.

21. Changes in particulars of beneficial owners
(1)

Where there is a change in any of the particulars of the beneficial owners specified in section 24 of the Act and regulation 18 included on the register of beneficial owners, the national sports association, national sports federation or community sports club shall amend the register of beneficial owners to reflect the change.

(2)

The national sports association, national sports federation and community sports club shall in writing, give notice to the council of any change referred to in subregulation (1).

(3)

Where a national sports association, national sports federation or community sports club fails to comply with this regulation, the national sports association, national sports federation or community sports club and every officer who is in default, shall be liable to a fine of twenty-five currency points.

Part VIII

22. Registration of community sports club
(1)

A person who intends to register a community sports club shall- (a) apply to the Council for registration in Form 10 prescribed in Schedule 2 to these Regulations; and

(b)

pay the fee prescribed in Schedule 3 to these Regulations.

(2)

A community sports club that intends to be registered with the Council shall-

(a)

be composed of not less than one hundred natural persons and not less than six groups of at least twenty-five persons;

(b)

have at least one sports discipline;

(c)

have been in existence for at least one year before the date of application; and

(d)

be affiliated to a national sports federation of each national sports discipline.

(3)

An application for registration under this regulation shall be accompanied with-

(a)

a certified copy of the constitution of the community sports club;

(b)

proof of affiliation with the national sports federations for each of the sports disciplines that the applicant community sports club intends to participate in;

(c)

a list of the members of the community sports club;

(d)

a report of the sports activities of the community sports club conducted within a period of one year prior to the application;

(e)

proof of payment of the application fee;

(f)

proof of ownership or guarantee of the sports facility housing the applicant community sports club;

(g)

a list of certified technical personnel to train the athletes and

(h)

any other information that may be required by the Council.

25. Revocation of certificate of registration of

community sports club (1) The Council may revoke the certificate of registration of a community sports club where the Council is satisfied that-

(a)

the community sports club has violated the terms or conditions of the certificate of registration;

(b)

the community sports club no longer meets the requirements for registration as a community sports club;

(c)

the community sports club has breached the provisions of the Act, these Regulations or any other law;

(d)

the registration of the community sports club was procured through misrepresentation or non-disclosure of material facts;

(e)

the community sports club is no longer recognised by the national sports governing body to which the community sports club is affiliated;

(f)

the community sports club no longer serves the purpose for which it was registered; or

(g)

the community sports club is declared insolvent by a court of competent jurisdiction.

(2)

The Council shall, before revoking a certificate of registration of a community sports club, notify the community sports club in writing, of the intention to cancel the certificate and the reasons for the revocation.

(3)

The Council shall provide the community sports club whose certificate is to be cancelled, an opportunity to be heard.

(4)

The Council shall within fourteen days from the date of revocation of the certificate of registration, remove from the register of national sports associations or national sports federations, a community sports club whose certificate of registration is revoked.

(5)

A community sports club whose certificate of registration is cancelled shall cease to operate as a community sports club.

(6)

A community sports club which is dissatisfied with the decision of the Council may, in writing, within fourteen days from the date of receipt of the decision, appeal to the Minister.

26. Governance of community sports clubs
(1)

A community sports club shall be governed in accordance with these Regulations and its Constitution.

(2)

The Constitution of the Community Sports Clubs shall include- (a) the composition of the general assembly, comprised of members duly registered by the club;

(b)

the procedure for admission, suspension and dismissal;

(c)

provision for the mandatory annual general meeting or assembly;

(d)

the powers of the general assembly, including- (i) the amendment of the Constitution and any other statutes of the community sports club;

(ii)

considering and passing the financial statements of the previous financial year of the community sports club;

(iii)

consideration and passing of the financial projections or budgets of the next financial year of the community sports club;

(iv)

the appointing of external auditors for a limited period;

(v)

the electing of the executive committee of the community sports club; and

(vi)

provision for the determining and passing of annual membership fees and the benefits of the fully paid- up members;

(e)

the composition of the executive committee;

(f)

the mandatory quarterly executive committee meetings;

(g)

the powers and obligations of the executive committee including-

(i)

organising the general assembly;

(ii)

presenting matters and drawing proposals for consideration by the general assembly;

(iii)

appointing and supervising the secretariat of the community sports club;

the rights and obligations of the individual members or member including-

27. Supervision of community sports club
(1)

The respective national sports federation shall supervise a community sports club.

(2)

The respective national sports federation may-

(a)

inspect the offices and facilities of the community sports club or appoint a person to inspect the offices and facilities on its behalf; and

(b)

undertake or cause an audit of the books of accounts and records of the community sports club.

(3)

The respective national sports federation shall, in every year, examine the compliance of the community sports club the national sports federation supervises with to-

(a)

the Act;

(b)

these Regulations;

(c)

the constitution of the respective national sports federation or association;

(d)

any other law; and

(e)

the constitution of the community sports club.

(4)

The respective national sports federation shall, in the case of non-compliance by a community sports club, direct the club to remedy the non-compliance not later than ninety days from the date of notification of the non-compliance.

(5)

The respective national sports federation shall submit to Council, a compliance report relating to the community sports club, for every year.

29. Operating sports academy
(1)

A person who intends to operate a sports academy shall-

(a)

apply to the Council for a licence, on the recommendation of a national sports federation, in Form 11 prescribed in Schedule 2 to these Regulations; and

(b)

pay the application fees prescribed in Schedule 3 to these Regulations.

(2)

A national sports federation shall not issue a recommendation under subregulation (1) (a), unless the applicant has complied with the regulations of the federation.

(3)

The Council shall, in considering an application for licensing a sports academy-

(a)

safeguard the rights of children including the right to education;

(b)

ensure compliance with other laws, including the Children Act; and

(c)

safeguard the welfare and best interests of the child.

(4)

An application for a licence under this regulation shall be accompanied with -

(a)

a certificate of approval from the National Sports Federation;

(b)

a certified copy of a certificate of incorporation of the sports academy, where applicable;

(c)

evidence of payment of the prescribed fee; and

(d)

a technical and financial proposal.

30. Consideration of application to operate sports academy
(1)

32. Revocation of licence to operate sports academy
(1)

The Council may revoke a licence to operate a sports academy where the Council is satisfied that-

(a)

the sports academy has violated the terms or conditions of the licence;

(b)

the sports academy no longer meets the requirements for licence to operate as a sports academy;

(c)

the sports academy has breached the provisions of the Act, these Regulations or any other law;

(d)

the licensing of the sports academy was procured through misrepresentation or non-disclosure of material facts;

(e)

the sports academy is no longer recognised by the national sports governing body to which the sports academy is affiliated;

(f)

the sports academy no longer serves the purpose for which it was licensed;

(g)

the sports academy is declared insolvent by a court of competent jurisdiction;

(h)

the sports academy has violated the rights or welfare of a child; or

(i)

the respective national sports federation has filed for revocation of the licence in respect of violation of the conditions in the recommendation under regulation 29 (2).

(2)

The Council shall, before revoking the licence of a sports academy, notify the sports academy in writing, and shall give the sports academy an opportunity to provide a written response within fourteen days, before the Council makes a decision.

(3)

Where the applicant is dissatisfied with the decision of the Council revoking the licence to operate a sports academy, the applicant shall, within twenty-one days of the decision, appeal to Minister.

(4)

A sports academy whose licence is revoked shall cease to operate as a sports academy.

(5)

The Council shall, within fourteen days from the date of revocation of the licence, remove from the register of sports academies, a sports academy whose licence is revoked.

Part IX

34. Appeals to Minister
(1)

Upon receipt of an appeal lodged under these Regulations, the Minister may request for further information from the appellant or the Council.

(2)

The information referred to in subregulation (1) shall be provided in writing.

(3)

The Minister shall, within twenty-one days from the date of lodging the appeal-

(a)

confirm, vary or revoke the decision of the Council; or

(b)

make a new decision.

(4)

  1. (1) Upon receipt of an appeal lodged under these Regulations, the Minister may request for further information from the appellant or the Council.
  2. (2) The information referred to in subregulation (1) shall be provided in writing.
  3. (3) The Minister shall, within twenty-one days from the date of lodging the appeal-
  4. (a) confirm, vary or revoke the decision of the Council; or
  5. (b) make a new decision.
  6. (4) The decision of the Minister under subregulation (3) shall take effect on the date stated in the letter, and shall be final and binding on the parties.

35. General penalty

A person who contravenes any provision in these Regulations, commits an offence and is liable, on conviction, to a fine not exceeding seventytwo currency points or to a term of imprisonment not exceeding one year, or both.

36. Revocation of S.I. No. 38 of

The National Council of Sports Regulations, 2014 are revoked.
