Section 139: Amendment of Schedules

(1) The Minister may, by statutory instrument amend the First Schedule of this Act. (2) The Minister may, with the approval of Parliament and by statutory instrument, amend the list of accountable persons in the Second Schedule by- (a) adding to the list any person or category of persons if the Minister reasonably believes that that person or category of persons is used, or is likely to be used in the future, for money laundering purposes; (b) deleting any person or category of persons not being used, and not likely to be used in the future, for money laundering purposes; or (c) making technical changes to the list. (3) Before the Minister amends the Second Schedule in terms of subsection (2) (a) or (b), the Minister shall consult the Board; and where- (a) only one person will be affected by the proposed amendment, give that person at least thirty days' written notice to submit written presentations to the Minister; or (b) a category of persons will be affected by the proposed amendment, by notice in the Gazette give persons or persons belonging to that category at least sixty days' written notice to submit written representations to the Minister.
