(1) A labour officer may institute civil or criminal proceedings before the Industrial Court in respect of a contravention or alleged contravention of this Act or regulations made under this Act, and may prosecute and appear in his or her own name in respect of the proceedings. (2) The rules of evidence shall apply in any criminal proceedings under this Act, but shall not apply in any civil Act 6 Employment Act 2006 proceedings before the Industrial Court.
