Section 16: Extension of letter of no objection

(1) A project proponent who has commenced activities and has complied with the reporting obligations under regulation 15 may apply for extension of the validity of the letter of no objection, stating the reasons for the extension. (2) An application referred to in subsection (1) shall be submitted to the Minister at least 3 months before the expiry of the letter of no objection. (3) Where the Minister is satisfied with the reasons for seeking an extension of validity of a letter of no objection, he or she shall grant an extension. (4) Notwithstanding subregulation (3), the extension of a letter of no objection shall not- (a) exceed twenty-four months at a time; and (b) be granted more than twice.
