Section 174: Remuneration of provisional administrator or administrator

Consolidated text
(1) A provisional administrator or administrator is entitled to-
(a) the remuneration agreed upon; or
(b) remuneration fixed by the court on application for taxation and assessment of costs and fees
of the administrator or provisional administrator, where no remuneration is agreed upon.
(2) During or after a provisional administration or administration, on the application of a provisional
administrator or administrator, a creditor of the company or a liquidator or provisional liquidator of the company, court may-
(a) in respect of any period, review or fix the remuneration of the provisional administrator or administrator, at a level which is reasonable;
(b) where the amount retained by the provisional administrator or administrator is found by
the court to be unreasonable in the circumstance, order the provisional administrator or administrator to refund the amount; or
(c) determine whether the provisional administrator or administrator, was validly appointed or
validly assumed custody or control of any property.
