Section 49: Offences by body of persons

(1) Where an offence is committed by a body of persons- (a) in the case of a body corporate, every director and the secretary of the body shall be deemed to have committed the offence; and (b) in the case of a partnership or other body not being a body corporate, every partner or member shall be deemed to have committed the offence. Act 19 Copyright and Neighbouring Rights Act 2006 (2) No person shall be taken to have committed an offence under subsection (1) if he or she proves to the satisfaction of the court that the offence for which he or she is charged was committed by some person other than himself or herself and was without his or her consent or connivance and that he or she exercised all diligence to prevent the commission of the offence as he or she ought to have exercised in the circumstances.
