(Under sections 183 and 33(c) of the Petroleum (Exploration, De<trelopment and Production) Act, 2013,-Act,No. 3 of 2013)

IN EXERCISE of the powers confened upon the Minister resp9nsible for petroleum activities by section 183 of the Petroleum (Exploration, Development and Production) Act, 2013, these Regulations are made this 16th day of September, 2014.

1. Title

These Regulations may be cited as the Petroleum (Exploration, Development and Production) (Sale of Data) Regulations, 2014.

This Instrument shall be deemed to have come into force on 1st July, 2014.

These Regulations apply to the sale of data by the Government of Uganda.

4. Interpretation

In these Regulations, unless the context otherwise requires-

"Act" means the Petroleum (Exploration, Development and Production) Act, 2013;

"data" means the geological, geochemical and geophysical data specified in Schedule 2 to these Regulations and includes any pmt of that data;

"purchase" means attainment of data under these Regulations by an entity upm; payment of the prescribed fee and subject to entering a confidentiality agreement with Government; I

"sale" means issuance of data under these Regulation to an entity upon payment of the prescribed fee and subject to entering a confidentiality agreement with Government.

5. Application for purchase of data

( 1) A person who wishes to purchase data under these Regulations shall apply to the Minister in the Form set out in Schedule 1 to these

The application under subregulation (1) shall state-

(a)

the particulars of the applicant including the name, address, legal status and location;

(b)

the data applied for;

(c)

the purpose for which the data is to be used;

(c)

previous experience on petroleum activities; and

(d)

any other information that the applicant deems necessal'y.

(3)

An application for purchase of data under these Regulations shall not be made by applicants in joint venture.

(4)

The Minister shall, within thirty days of receipt of an application, consider the application and determine whether or not to allow the sale of the data to the applicant.

(5)

The Minister may, in considering an application under subregulation (3) require the applicant to furnish further patticulars or information to enable the Minister determine the application.

(6)

Where the Minister refuses an application for purchase of data under these Regulations, the Minister shall inform the applicant in writing giving reasons for the refusal of the application. I

(7)

A person whose application is refused by the Minister may reapply for the purchase of data in accordance with these Regulations .

..., (1) The fees payable for data under these Regulations shall be as prescribed under Schedule 2 to these Regulations or as maybe specified by the Minister by notice in the Gazette.

(2)

The fees referred to in paragraph (1) shall be paid into a bank account designated by the Authority.

( 1) All data purchased under these Regulations shall be kept confidential in accordance with the Petroleum (Exploration, Development and Production) Act, 2013 and these Regulations.

The applicant shall enter into a confidentiality agreement with the Government of Uganda before purchasing data under these

Where the Minister grants the application under regulation 4 and upon confirmation of payment of the fees referred to in regulation 5 and signing of a confidentiality agreement, the Minister shall cause the data to be issued to the applicant in form of FTP, Disk, DVD, CD or other format of the applicant's choice.

A person who contravenes regulation 4 or 7 commits an offence and is liable on conviction to a fine not exceeding five thousand currency points or imprisonment not exceeding ten years or both.
