Weights and Measures (Testing and Stamping) Fees Rules

2. Where

a person invites an Inspector to a place which is Add-tx*-3 fees not the Inspector's office or which is not a stamping station set up by the Executive Director for the purposes of verifying, stamping or adjusting weights, measures, weighing or measuring instruments, such person shall, in addition to the other fees payable under these Rules, pay to the Inspector the fees set out in Schedule 4 to these Rules.

3. (1) The fees payable under

the provisions of these Rules Fees payable ° shall be paid on demand to the Inspector who performs the in Inspedoc service in respect of which the fee is charged.

(2)

When the Inspector receives the fees referred to in sub-rule (1) of this rule, he shall pay such fee to the bank account in accordance with the instructions issued by the Executive Director.

4. Where a weighing or measuring equipment

has been Failure io pay fed stamped under the provisions of these rules, but the person responsible for the equipment fails to pay the fees required under these rules, the Inspector shall-

{a) seize and detain the equipment or part thereof until such time as the fees are paid; or (b) in the case of equipment which cannot be easily seized and detained, apply a preventive-seal to the equipment in such a manner as to prevent further use of the equipment until payment is made:

Provided that this rule shall not apply to a person to whom credit facilities have been granted in writing by the Inspector who has performed the work.

5. A preventive seal applied under rule 4 (c) of

these rules Preventive seal shall consist of a wire tying an operative part of the equipment against a fixed part thereof, and soft metal upon which the Inspector's mark shall be impressed.

Breaking of 6. a preventive seal applied under these rules shall be broken only by an Inspector of Weights and Measures.

Penalty. 7. A person who contravenes the provisions of rule 6 or uses or has in his possession or control for use for trade any weighing or measuring equipment on which a preventive seal was applied and broken contrary to rule 6 commits an offence and is liable on conviction to a fine not exceeding three thousand shillings or to a term of imprisonment not exceeding three months or to both such fine and imprisonment.

Recovering 8. Where a preventive seal has been applied under rule 4 ofprevtous 0^ these pjjgg tfoe person responsible for the equipment shall still remain liable for the payment of the appropriate fees which were demanded of him together with the relevant fees or charges in respect of the restamping or the removal of the preventive seal.

Period of 9, A stamp of verification which is applied on an instru- ment under the provisions of section 15 of the Act shall remain in force- (a) in respect of a weighing or measuring instrument used for weighing or measuring goods in a factory for trade purposes for a period not exceeding six months; and (b) in respect of a weighing or measuring instrument used for weighing or measuring goods in other trades, for a period not exceeding twelve months.

"Capacity" when used in respect to a weighing instru ment, includes the weight marked on the taring device where this has been fitted.

"Act" means the Weights and Measures Act, Cap. 101 as amended by the Weights and Measures (Amendment) Act No. 9 of 1969.

"Executive Director" means the Executive Director of the Uganda National Bureau of Standards (UNBS).

Any other word or words used in these rules will have the same meaning assigned to them in the Act.

11. The Weights and Measures (Testing and Stamping) Fees Revoac*

of S.L J* Rules, 1985 and the Weights and Measures (Testing and 28 of Stamping) (Amendment) Rules 1987 are hereby revoked. &S.I.NX 57 of

Rules may be cited as the Weights and Measures Gudocl (Testing and Stamping) Fees Rules, 1996.

SCHEDULES

FIRST SCHEDULE-(Rule 1)

TESTING FEES

1. WEIGHT: Ug. Shs

For each weight exceeding 100kg 1.000

2. MEASURES OF LENGTH

For each measure not exceeding one metre 200 For each measure exceeding one metre and not exceeding 5 metres 500 For each measure exceeding 5m and not exceeding 30m 1.000 For each measure exceeding 30m 2,000

3. MEASURES OF CAPACITY: Ug. Shs

For each measure exceeding 5 litres and not exceeding 20 litres 1,000 For each measure exceeding 20 litres and not exceeding 100 litres 2,000 For each measure exceeding 100 litres and not exceeding 500 litres 3,000 For each measure exceeding 500 litres, every 500 litres will be charged at a rate of 3,000

7. VOLUMETRIC FILLERS: Ug. Shs

9. PATTERN TESTING

The fee payable for small simple equipment shall not be less than 10,000 and the fee for big complex equipment shall not exceed 100,000 The fee will be determined by the panel approving the pattern, depending upon the size and simplicity or complexity of the equipment

STAMPING FEES

E. MATERIAL USED: For the cost of materials used, an appropriate fee determined at the discretion of the Executive Director based on the open market of the material.

FOURTH SCHEDULE-(Rule 2)

TRANSPORT FEE

The transport fee, where applicable, shall be the Government hiring rates or opei market transport rates that may be in existence at the time of the performance of th| work, covering the total travelling distance which such attendance necessitates:

Provided that where an Inspector or Examiner is delayed in the performanc of his duties to the negligence of the mechanic or the person in charge of the instn ment, that mechanic or person, as the case may be, shall be liable to pay an appropriate fc determined at the discretion of an Inspector or Examiner.
